Terms and Conditions

Scope

These Terms and Conditions ("Terms") apply to all purchases made through the Mijospace website, operated by Mila Rheydt, sole proprietor based in Germany ("Mijospace", "we", "us", or "our").

Our products are offered to both consumers ("B2C") and business customers ("B2B"). By placing an order, you agree to these Terms.

Products

Mijospace offers digital products, including but not limited to:

  • Illustrations
  • Premade Designs
  • Exclusive Designs
  • Custom Design Services
  • Seamless Patterns
  • Fonts
  • Digital Downloads
  • Digital Graphic Assets

All products are delivered digitally. No physical items are shipped unless explicitly stated.

Contract Formation

The presentation of products on our website does not constitute a legally binding offer.

A purchase contract is concluded once your order has been accepted and payment has been successfully processed.

You will receive an order confirmation via email.

Prices and Payment

All prices displayed on the website are stated in the applicable currency and include or exclude VAT as required by applicable law.

Payment must be completed before any digital files are delivered.

We reserve the right to refuse or cancel orders in cases of payment failure, suspected fraud, or misuse.

Delivery

Digital products are delivered electronically.

After successful payment, customers receive immediate access to the purchased files unless otherwise stated.

Customers are responsible for providing a valid email address and ensuring download access.

License and Intellectual Property

Unless explicitly stated otherwise, all copyrights, trademarks, and intellectual property rights remain the exclusive property of Mila Rheydt, owner of Mijospace.

The purchase of any digital product does not constitute a transfer of copyright ownership. Customers receive only the usage rights expressly granted with the purchased license.

The purchase of a digital product grants only the usage rights described in the respective product listing.

Ownership of the artwork itself is never transferred unless explicitly agreed in writing.

Shared License

Products sold under a Shared License are licensed to multiple customers.

Customers may use the purchased design commercially within the scope described on the product page.

The following is not permitted:

  • Reselling the original files.
  • Redistributing the files.
  • Sharing the files with third parties.
  • Claiming the design as your own work.
  • Selling, sublicensing, or giving away the digital files.
  • Uploading the files to stock websites or marketplaces.
  • Using the files to train artificial intelligence or machine learning systems without written permission.

Exclusive License

Products sold as Exclusive Designs are licensed exclusively to one customer.

Once purchased, the design will be permanently removed from sale and no further licenses will be granted.

Unless explicitly agreed otherwise in writing:

  • Copyright remains with Mila Rheydt, owner of Mijospace.
  • The customer receives the exclusive usage rights specified in the purchase agreement.
  • Further modifications or additional deliverables may be subject to additional fees.

Custom Design Services

For custom illustration or design work:

  • The scope of work is agreed individually.
  • Prices are quoted individually.
  • Timeframes are estimates unless otherwise agreed.
  • Revision rounds included in the project are specified before work begins.
  • Additional revisions or change requests may incur additional charges.

Mijospace reserves the right to showcase completed work for portfolio and promotional purposes unless confidentiality has been agreed in writing.

Fonts

Fonts purchased from Mijospace include the license specified on the product page.

Unless otherwise stated, customers may use the font commercially under the purchased license.

Customers may not:

  • Resell the font files.
  • Redistribute the font.
  • Modify and resell the font.
  • Share the font with third parties.
  • Claim authorship of the font.

Refund Policy

Due to the nature of digital products, refunds are generally excluded once the files have been delivered or downloaded, except where mandatory consumer protection laws provide otherwise.

If a product is defective or inaccessible, customers should contact us so we can provide a replacement or resolve the issue.

Consumer Right of Withdrawal

For consumers within the European Union, the statutory right of withdrawal applies unless it has legally expired.

For digital content, the right of withdrawal expires once:

  • the customer has expressly consented to the immediate execution of the contract before the withdrawal period expires; and
  • acknowledged that by giving such consent they lose their statutory right of withdrawal,

provided that all legal requirements under applicable consumer protection law have been fulfilled.

Limitation of Liability

Mijospace shall not be liable for indirect, incidental, or consequential damages arising from the use of purchased digital products, except where liability is mandatory under applicable law.

Nothing in these Terms limits liability for intent, gross negligence, personal injury, or other liabilities that cannot legally be excluded.

Applicable Law

These Terms shall be governed by the laws of the Federal Republic of Germany.

If you are a consumer residing within the European Union, mandatory consumer protection provisions of your country of residence remain unaffected.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
